Philip McCardel's Will

In the name of God, amen -

I, Philip McCardel of the county of Washington, & state of Tennessee, being weak in body and of sound mind & memory knowing that my earthly course is nearly ended do now make and publish my last will and testament in manner and form following, to wit;

1st It is my will that all my just debts (at my decease) and my funeral expenses be paid out of my estate before there is any division of the same.

2nd It is my will that at my decease all my property (except what may hereafter by this will be excepted) shall be sold by my executors on a credit of twelve months or more as may appear most eligible to the highest & best bidder.

3rd I will and bequeath to my daughter Esther Thornburgh & her children all my wearing apparel,

4th I will and bequeath all my estate both real & personal with the above exception to my dear children, Rebecca Tucker, John McCardel, Nancy Miller, Esther Thornburgh, & Hannah Speck, to be divided equally among them, share and share alike with the exception that Rebecca Tucker is to have forty three dollars more than Hannah Speck and Hannah Speck forty three dollars less than the other legatees on account of Rebecca Tucker paying that sum to Mathew Stephenson for and on account of the said Hannah Speck.

Lastly, I appoint my friend Jessie Smith sole executor of this my last will authorising him to convey my land when sold as above and it is further my desire that no surety be required of him. I do hereby revoke all former wills by me made - declaring this only to be my last will and testament, April 17th , 1826. Signed, sealed, published and declared by the testator to be his last will in presence of us who at his request and his presence subscribed the same as witnesses.

The foregoing will was proven in open court by the author. of Mathew Stephenson & James Payne the subscribing witnesses thereto at April Sessions, 1827 & recorded.
