This Indenture made this tenth day of February one thousand seven hundred and eighty nine Between Jonathan Tipton of Washington County in No. Carolina of the one part and Oliver Wallace of the county and state aforesaid of the other part witnesseth that he the said Jonathan Tipton for and in consideration of the sum of forty pounds to him in hand paid by him the said Oliver Wallace the receipt whereof he the said Jonathan Tipton doth hereby acknowledge that he the said Jonathan Tipton hath granted, bargained, sold aleined and confirmed and by these presents doth grant, bargain, and sell alein and confirm unto the said Oliver Wallace, his heirs and assigns forever all that tract or parcel of land lying and being in the county of Washington on the south side of the Cherroes(?) Creek joining Ambrose Hodges and William Murphey's lines beginning at a buckeye ----- and Whiteoak a corner of Ambrose Hodges line of said survey North seventy one degrees West one hundred and nine poles to a Spanish oak in the line of the original survey; thence with Murphey's line South twenty fives degrees West one hundred and sixty light poles to a dogwood on Mr. Wattson's line; thence with said line South sixty degrees East thirty one poles on the Crossing line of the original survey thence straight to the beginning corner. Eighty acres more or less and also the ------- and -------remainder and remainders rents and ------- of, in and to the said land and premises above mentioned all and singular in every part and parcel thereof to nthe said Oliver Wallace, his heirs and assigns forever to have and to hold, possess, and enjoy with their appurtainances and he the said Jonathan Tipton for himself and his heirs and against him and his heirs and against all and every other person or persons claiming or to claim will warrant and forever defend from all person or persons whatsoever shall or may claim now or hereafter.
